TERMS OF SERVICE – CUSTOM TUNING SERVICES

GAP Tuning Effective Date: August 18, 2026

Please read these Terms of Service ("Terms") carefully before purchasing or authorizing any custom tuning service from GAP Tuning. By proceeding with any service, you agree to be bound by these Terms.

1. Services Provided

GAP Tuning provides custom engine calibration and tuning services ("Services") for customer vehicles. All tuning is performed on a vehicle-specific basis and is tailored to the individual customer's vehicle, modifications, and performance goals.

2. Customer Eligibility and Authorization

By authorizing any Service, the customer confirms that:

  • They are the legal owner of the vehicle or have authorization from the legal owner
  • They are at least 18 years of age
  • The vehicle is street-legal or intended for off-road/track use only where applicable
  • They have disclosed all relevant vehicle modifications, conditions, and intended use to GAP Tuning

3. Vehicle Condition

The customer is solely responsible for ensuring their vehicle is in proper mechanical condition prior to any tuning service. GAP Tuning reserves the right to refuse service on any vehicle deemed mechanically unfit. Tuning a vehicle in poor condition is done entirely at the customer's risk.

4. No Liability for Damages

GAP Tuning shall not be held liable for any engine damage, mechanical failure, or related losses arising from:

  • Pre-existing mechanical issues or deferred maintenance
  • Customer neglect or driver error
  • Modifications made to the vehicle after tuning
  • Use of low-quality or incorrect fuel, oil, or fluids
  • Racing, competition, or aggressive driving beyond the vehicle's mechanical limits

5. Refund Policy

All custom tuning services are non-refundable once the base map has been delivered. Delivery is considered complete upon electronic transmission of the tune file, flashing of the ECU, or any physical or digital transfer of the tune to the customer. See our full Refund Policy for details.

6. Intellectual Property

All tune files, calibration data, and maps created by GAP Tuning remain the intellectual property of GAP Tuning. The customer is granted a limited, non-transferable license to use the tune file on their specific vehicle only. Redistribution, resale, reverse engineering, or modification of any tune file is strictly prohibited.

7. Off-Road and Emissions Disclaimer

Some tuning modifications may affect vehicle emissions systems. It is the customer's sole responsibility to ensure compliance with all applicable federal, state, and local emissions laws and regulations. GAP Tuning assumes no liability for emissions-related violations, failed inspections, or legal consequences resulting from tuning services.

8. Revisions

Post-delivery revision requests are handled at GAP Tuning's discretion and may be subject to additional fees. Revisions do not constitute a new service agreement and do not reset or alter the terms of this agreement.

9. Limitation of Liability

To the maximum extent permitted by law, GAP Tuning's total liability for any claim arising out of or related to its Services shall not exceed the amount paid by the customer for the specific service in question. GAP Tuning shall not be liable for any indirect, incidental, consequential, or punitive damages.

10. Indemnification

The customer agrees to indemnify and hold harmless GAP Tuning, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from the customer's use of the Services, vehicle operation, or breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising under these Terms shall be resolved in the appropriate courts of Illinois.

12. Changes to Terms

GAP Tuning reserves the right to update or modify these Terms at any time. Continued use of our Services following any changes constitutes acceptance of the revised Terms.
